DRAM SHOP REFORM IS NEEDED NOW!!!
The run away costs of Dram Shop insurance is jeopardizing the system intended to compensate victims harmed by the illegal sale of alcohol to someone under 21 or the sale of alcohol to an obviously intoxicated customer.
What is the problem? Recent case law has broadened the potential claims to the point where "A" rated insurance companies refuse to offer Dram Shop insurance in the state of Minnesota. While the intent of Judge and juries is well meaning, the result has been devistating. The potential claims have become astronomical under current definitions. The potential claims can not be sustained with only 6,500 businesses paying into the system.
Only a handful of companies are writing Dram Shop and one is a "B-" rated company. What is "B-" you ask? In our K-12 system it would be the equivalent to a "F". What does this mean? It means that should a victim need to be compensated, the liklihood of funds being available is very slim.
What needs to be done? The state legislature needs to redefine the law so that insurance company actuaries can adequately predict risk and charge appropriate premiums. This will allow insurance companies to reenter the market. This will allow for a competitive market that will provide affordable insurance from "A" rated companies that will protect all Minnesotans.
