Info for retailers of hemp-derived cannabinoid products

During the recent legislative session, authority for regulating sales of edible cannabinoid products, aka hemp-derived cannabinoid products (edibles, beverages, and topicals), was transferred from the Board of Pharmacy to the Minnesota Department of Health (MDH) Sec. 151.72 MN Statutes.

The new legislation requires all existing retailers register their establishment with the Minnesota Department of Health no later than October 1, 2023. The registration form is available now click here. The link is also posted on the MDH Edible Cannabinoid webpage at Edible Cannabinoid Products – MN Dept. of Health (state.mn.us) .

MDH has begun conducting inspections of retail establishments that sell hemp-derived cannabinoid products. Retailers are encouraged to prepare for an inspection by ensuring they are compliant with the regulations. A fact sheet is available to guide retailers in assessing available product inventory and customer access (https://www.health.state.mn.us/people/cannabis/edibles/docs/productcompliance.pdf). If you have questions, please contact MDH at [email protected].

Please feel free to share this communication with others who may be impacted.

Additional information regarding product testing, packaging, labeling, marketing, advertising, and sales tax can be found at Edible Cannabinoid Products – MN Dept. of Health (state.mn.us). Check the website often for updates.

Kindest regards,
