MN Appeals Court Rules ‘Open All’ Function of E-Tabs Illegal

On Monday, February 27th, the Minnesota state Court of Appeals ruled that the “Open All” feature of electronic pull tabs is illegal.  The Shakopee Mdewakanton Sioux tribe had challenged the open-all function in 2019, saying it mimics slot machines. Today’s  ruling reversed an administrative law judge’s decision that found the open-all provision was legal.

The issue here today is that emails from the Minnesota Gambling Control Board in 2019 said it would no longer approve electronic pull-tabs with the open-all function but then reversed itself a few days later telling vendors it would consider electronic pull tabs with the open-all feature case-by-case. The Court said that because of this, the GCB cannot say there is a longstanding rule that Open-all feature is ok.
